Terms of service

The agreement between you and UltimateFunded when you use our website, create an account or take part in our trading programs.

Effective date: 24 September 2026 · Last updated: 24 September 2026

1. Agreement to these terms

These Terms of Service (“Terms”) are a legally binding agreement between you and UltimateFunded (“UltimateFunded”, “we”, “us” or “our”). They govern your use of our website (ultimatefunded.com), our trader area (app.ultimatefunded.com) and all challenges, evaluations, funded accounts, payouts and related services (together, the “Services”).

By creating an account, purchasing a challenge or otherwise using the Services, you confirm that you have read, understood and agree to these Terms. If you do not agree, you must not use the Services.

The following documents form part of these Terms and are incorporated by reference:

If there is a conflict between these Terms and the Trading Rules on a trading matter, the Trading Rules apply. In all other cases, these Terms apply.

2. Definitions

  • Challenge or Evaluation — a paid program in which you trade a simulated account to show that you can meet our profit targets while following our risk rules.
  • Challenge Fee — the fee you pay to access a Challenge. It is a fee for a service, not a deposit or investment.
  • Funded Account — a simulated account offered to you after you pass a Challenge, or directly through an Instant Funding program, on which you may earn Payouts.
  • Payout — a performance reward we pay you, calculated as a share of simulated profits on a Funded Account in line with your program’s profit split.
  • Trader Area — your online dashboard at app.ultimatefunded.com.
  • Trading Platform — MetaTrader 5 or any other platform we make available.

3. Nature of our services

UltimateFunded provides trader evaluation and education services. Please read this section carefully.

  • All accounts are simulated. Challenge, evaluation and funded accounts use simulated funds in a simulated trading environment. Your trades are not executed on a live market, and you do not own or control any real capital.
  • We are not a broker or investment firm. We do not accept deposits, hold client money, execute trades on your behalf, manage investments or provide investment, financial, tax or legal advice.
  • Payouts are rewards, not investment returns. Payouts are discretionary performance rewards paid under these Terms. They are not wages, dividends, interest or profits from any investment.
  • No employment or partnership. Nothing in these Terms makes you our employee, agent, partner or joint-venturer. You are not authorised to act or speak on our behalf.
  • We may use your trading data. We may, at our discretion, copy, mirror or otherwise use the trading activity on your accounts in our own risk-management or trading decisions. You are not entitled to any payment or information about this beyond your Payouts.

Trading leveraged products such as CFDs, forex, indices and commodities carries a high level of risk. Results on a simulated account do not guarantee results in live markets.

4. Eligibility

To use the Services you must:

  • be at least 18 years old and have full legal capacity to enter into a binding contract;
  • not live in, or be a citizen of, a restricted country, and not be subject to sanctions imposed by the United Nations, European Union, United Kingdom or United States;
  • use the Services in your own name and for your own account, not on behalf of anyone else;
  • not be barred from using the Services under the laws that apply to you.

You are responsible for making sure that your use of the Services is lawful where you live. We may refuse service, close accounts or withhold Payouts if we reasonably believe you do not meet these requirements, including where you have used a VPN or false information to hide your location.

5. Your account

  • Accurate information. You must give true, accurate and complete information when you register, and keep it up to date. Your name must match your identity documents.
  • One person, one profile. You may hold only one Trader Area profile. You may hold more than one Challenge or Funded Account under that profile where our program rules allow it.
  • Security. You are responsible for keeping your Trader Area and Trading Platform credentials confidential. You must not share, sell or transfer your accounts or credentials, or let anyone else trade on your accounts. You must not change the master password issued for a Trading Platform account.
  • Responsibility. You are responsible for all activity on your accounts. Tell us immediately if you suspect unauthorised access.

6. Fees, payments and refunds

  • Prices. Challenge Fees, reset prices and any activation fees are shown on our website and at checkout. Prices are in US dollars unless stated otherwise and may change at any time. A price change does not affect a purchase you have already completed.
  • Payment. We accept the payment methods shown at checkout, which may include card and cryptocurrency. Payments are handled by third-party payment processors. You are responsible for any bank, network or currency-conversion charges.
  • Coupons. Discount codes are subject to their own conditions, cannot be combined unless stated, have no cash value, and may be withdrawn at any time.
  • Refunds. Refunds are handled under our Refund Policy. In summary, you may request a refund if you have not started trading within 14 days of registration, and fees are non-refundable once any trading activity has taken place.
  • Chargebacks. If you believe a charge is wrong, contact support first. If you start a chargeback or payment dispute without a valid reason, we may suspend or close all of your accounts, cancel pending Payouts, and recover any costs we incur.
  • Taxes. You are solely responsible for reporting and paying any taxes that apply to fees you pay or Payouts you receive.

7. Challenges and evaluations

  • Each Challenge has the profit target, loss limits, minimum trading days, leverage and other parameters shown on our challenges page, in the Trading Rules and at checkout at the time of purchase.
  • You pass a Challenge only when you meet all its objectives without breaching any rule. Breaching a hard rule, such as a daily or maximum loss limit, ends the Challenge immediately, and the account may be closed automatically.
  • Passing a Challenge makes you eligible for a Funded Account. It does not guarantee one: you must also complete identity verification and pass our review under section 11.
  • Where offered, you may reset a breached Challenge by paying the reset price shown in your Trader Area.
  • Accounts with no trading activity for an extended period may be deactivated as described in our Trading Rules.

8. Funded accounts

  • A Funded Account remains a simulated account. You must continue to follow all Trading Rules, including the additional rules that apply only to Funded Accounts.
  • We decide the account size, platform, server and instruments of each Funded Account. We may change trading conditions — such as leverage, spreads, commissions, available instruments or trading hours — to reflect market conditions or risk. We will give notice where reasonably possible.
  • A Funded Account may be closed if a rule is breached, if you break these Terms, or as described in section 19.

9. Payouts

  • Eligibility. You may request a Payout when your payout window is open and you meet the conditions in the Trading Rules, including minimum trading days, the minimum payout amount, and an active and verified account.
  • Calculation. Payouts are calculated on simulated profits for the payout period, after any deductions required by the Trading Rules (for example, profits from trades that broke the news rule or were flagged as prohibited scalping), and then multiplied by your profit split.
  • Review. Every Payout request is reviewed before payment. We may delay a Payout while we investigate possible rule breaches, and may deny it in whole or in part if a breach is confirmed.
  • Payment. Payouts are paid to the payout method in your profile, which must be in your own name. We are not responsible for delays or losses caused by incorrect payout details you provide, or by banks, networks or payment providers.
  • Fee refund. Where your program includes it, your Challenge Fee is refunded with your first Payout from a Funded Account, as described in our Refund Policy.
  • Recovery. If we pay a Payout by mistake, or later find that it was based on a rule breach or fraud, you must repay it on request, and we may deduct it from future Payouts.

10. Prohibited conduct

In addition to the prohibited strategies listed in our Trading Rules, you must not:

  • use trading strategies that exploit the simulated environment rather than reflect genuine market risk, including high-frequency trading, tick scalping, latency or reverse arbitrage, and exploiting price feed errors, delays or platform bugs;
  • hedge or coordinate trades across multiple accounts, whether your own or other people’s, or copy another trader’s signals or accounts;
  • let anyone else trade your accounts, trade someone else’s accounts, or use account management or passing services;
  • operate multiple profiles or use shared IPs or devices with other traders to get around our rules;
  • give false information, use someone else’s identity or payment details, or commit any fraud;
  • interfere with, reverse-engineer, scrape or overload our website, Trader Area or Trading Platform, or try to gain unauthorised access to them;
  • use the Services for money laundering, terrorist financing or any other unlawful purpose;
  • abuse, threaten or harass our staff or other members of our community.

11. Monitoring and enforcement

We monitor trading activity, account access and payments, using automated systems and manual review, to enforce these Terms and the Trading Rules. If we reasonably believe you have breached them, we may, at our discretion and in proportion to the breach:

  • issue a warning;
  • deduct profits made from prohibited trades;
  • delay or deny a Payout, in whole or in part;
  • reset, downgrade, suspend or close any or all of your accounts;
  • refuse future purchases;
  • report suspected unlawful activity to the relevant authorities.

Where a breach involves fraud, shared accounts or deliberate abuse, all accounts connected to it may be affected. Challenge Fees are not refunded when an account is closed for a breach. If you disagree with a decision, you may ask for a review through support within 14 days, and we will consider any information you provide.

12. Identity verification

You must complete identity verification (KYC) before a Funded Account is issued and before any Payout is paid. We may also ask for verification at any other time, including information about the source of funds used to pay for Challenges. If you do not provide the information we request, provide false or altered documents, or fail our sanctions or fraud checks, we may refuse to issue a Funded Account, withhold Payouts and close your accounts. We handle your KYC data as described in our Privacy Policy.

13. Affiliate program

If you join our affiliate program, commission rates and payment conditions are shown on the affiliate page and in your Trader Area. You must promote UltimateFunded honestly, must not make misleading claims about earnings or guaranteed results, must not bid on our brand name in paid search, and must not refer yourself or accounts you control. We may withhold commission for fraudulent, self-referred or refunded purchases, and may change or end the program at any time.

14. Intellectual property

The Services and all content on them — including our name, logos, website design, text, graphics, software and trading rules — are owned by or licensed to UltimateFunded and are protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable and revocable licence to use the Services for their intended purpose under these Terms. You must not copy, modify, distribute, sell or create derivative works from any part of the Services without our written permission.

If you send us feedback or suggestions, we may use them freely without any obligation to you.

15. Third-party platforms

The Services depend on third-party providers, including MetaTrader 5, data and price feed providers, payment processors and identity verification providers. Your use of their services may also be subject to their own terms. We are not responsible for their acts, omissions, outages or errors. If a platform or price feed error affects your account, we may, acting reasonably, adjust or cancel the affected trades and results.

16. Disclaimers

The Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we make no warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy or uninterrupted availability. We do not guarantee that you will pass a Challenge, receive a Funded Account or earn any Payout.

Educational material, market commentary and community content are for general information only and are not investment advice. You make your own trading decisions and are solely responsible for them.

17. Limitation of liability

To the fullest extent permitted by law:

  • we are not liable for any indirect, incidental, special, consequential or punitive loss, or for any loss of profits, revenue, opportunity, data or goodwill, however caused;
  • we are not liable for losses caused by platform downtime, connectivity problems, price feed errors, slippage, third-party failures, or events beyond our reasonable control;
  • our total liability to you for all claims arising out of or relating to the Services or these Terms is limited to the total Challenge Fees you paid to us in the 12 months before the event giving rise to the claim.

Nothing in these Terms limits liability that cannot be limited by law, such as liability for fraud, or for death or personal injury caused by negligence. If you are a consumer, you may have statutory rights that these Terms do not affect.

18. Indemnity

You agree to indemnify and hold harmless UltimateFunded and its officers, employees and partners from any claims, losses, liabilities, costs and expenses (including reasonable legal fees) arising from your breach of these Terms or the Trading Rules, your misuse of the Services, or your violation of any law or the rights of a third party.

19. Suspension and termination

You may close your account at any time by contacting support. Closing your account does not entitle you to a refund except as set out in our Refund Policy.

We may suspend or terminate your access to the Services, or any account, at any time if you breach these Terms or the Trading Rules, if required by law or a regulator, if we reasonably suspect fraud or abuse, or if we stop offering a program. Where we terminate an account without any breach on your part, we will pay any Payout you had validly earned up to the termination date and, for an unused Challenge, refund the Challenge Fee.

Sections that by their nature should survive termination — including those on fees, payout recovery, intellectual property, disclaimers, limitation of liability, indemnity and governing law — continue to apply after termination.

20. Changes to services and terms

We may change, suspend or discontinue any part of the Services, including programs, prices and Trading Rules, at any time. We may also update these Terms. The “last updated” date at the top shows when they were last changed. Material changes will be notified by email or in the Trader Area before they take effect. Changes do not apply retroactively to trades already placed. If you continue to use the Services after changes take effect, you accept the updated Terms. If you do not agree, you must stop using the Services.

21. Governing law and disputes

These Terms and any dispute arising out of or in connection with them are governed by the laws of the jurisdiction in which UltimateFunded is established, without regard to conflict-of-law rules.

If you have a complaint, please contact support first so we can try to resolve it informally. If a dispute cannot be resolved within 30 days, it will be submitted to the exclusive jurisdiction of the courts of that jurisdiction, unless mandatory consumer protection laws in your country of residence give you the right to bring proceedings in your local courts.

22. General

  • Entire agreement. These Terms, together with the documents listed in section 1, are the entire agreement between you and us about the Services.
  • Severability. If any provision is found invalid or unenforceable, the rest of these Terms remain in full force.
  • No waiver. If we do not enforce a right, that does not mean we waive it.
  • Assignment. You may not transfer your rights or obligations under these Terms. We may transfer ours, for example as part of a business sale or reorganisation.
  • Force majeure. We are not responsible for failure or delay caused by events beyond our reasonable control, including market disruptions, outages, natural disasters, war or government action.
  • Language. These Terms are written in English. If they are translated, the English version prevails.
  • Notices. We may send notices to the email address in your profile or through the Trader Area.
